Outstanda Voices – Terms of Service

1. Nature of the Service

Outstanda Voices is an AI-powered educational platform that evaluates student voice responses to generate insights into engagement and learning trends. Please note:

• AI-Based Results: The system is powered by artificial intelligence, which evolves over time. Results may sometimes vary or be imperfect.
• Focus on Trends: Individual scores are for general reference; the primary value lies in the identification of learning trends across time and responses.
• No Individual Review: Outstanda does not monitor or manually review individual student results. Use of the platform is at the discretion of the licensed organization.

2. License and Usage

• Group Licenses: A school, district, or organization may purchase a license allowing them to manage multiple users (students, instructors, and reporting staff).
• Sublicensing: Groups may assign licenses to students. Students can be removed from the group license at any time, freeing up the license for use with another person.
• No Residual Access: Once a student is removed from a license and sublicense, the school no longer has access to that student’s data—even in aggregated or anonymized formats.
• Admin/Instructor Roles: Instructors and admins can view all student names and data within the license to support learning and oversight.
• Reporting Access: Users with a “reporting” role can access aggregate data only, with student names and identifiers redacted.

3. Student Data Rights

• Data Portability: Students retain access to their data and may take it with them to another institution using Outstanda.
• Data Ownership: Students own their personal data. Organizations license access to the results while the student is actively licensed.
• Data Deletion: If a student is removed from a license, their data becomes inaccessible to the previous group and can only be accessed by the student or a new license holder, if transferred.

4. Privacy and Data Use

• FERPA & COPPA Compliance: Outstanda is committed to protecting student privacy in compliance with U.S. laws and applicable international laws.
• Data Use: Student data may be used internally for platform improvement and research, in anonymized and aggregated form only.
• Security: We apply appropriate security practices to safeguard all user information.

5. Limitations of Liability

Outstanda Voices is provided “as is”, without warranties of any kind. We make no guarantees regarding:

• The accuracy or consistency of AI-generated scores.
• The availability or uptime of the platform.
• Fitness of the tool for a specific educational or diagnostic purpose.

Outstanda shall not be liable for any indirect or consequential damages resulting from use or misuse of the platform.

6. Support and Communication

• Feedback: Suggestions submitted to us may be used without obligation or compensation.

7. Changes to Terms

We reserve the right to update these Terms at any time. Updates will be posted on our site, and continued use after changes constitutes acceptance of the revised terms.

8. Termination and Revocation

• Organizations may remove users at any time, which revokes their access.
• Outstanda may suspend or terminate access due to misuse or violation of these Terms.
• Licenses are non-refundable unless otherwise agreed in writing.

9. Governing Law

These Terms are governed by the laws of the State of Ohio, USA. Any legal actions related to the platform must be filed in Ohio courts.

10. Pricing and Cancellation

• No Refunds: All purchases are final. Outstanda does not offer full or partial refunds for licenses once purchased.
• Prorated Add-Ons: If you add licenses during the term, the cost will be prorated based on the remaining time until your annual renewal date. This ensures you maintain a single, unified renewal date each year.
• Renewal & Cancellation: To cancel, simply choose not to renew your licenses during the next renewal cycle. Your access will continue until the current license term ends, after which all access will be deactivated unless renewed.
